Welcome to Gipfelstürmer Social, a free-to-play social casino platform operated by Gipfelstürmer Werbeagentur GmbH, Industriestraße 4, 70565 Stuttgart, Germany (referred to in these Terms as "Gipfelstürmer Social", "we", "us" or "our"). These Terms and Conditions ("Terms") govern your access to and use of the website located at gipfelsturmerwerbeagentur.com, together with all games, features, content, tools and services made available through it (collectively, the "Service"). The Service is designed for players located in Australia, although these Terms apply to anyone who accesses it from anywhere in the world.
Before you go any further, please understand the single most important fact about this platform: Gipfelstürmer Social is an entertainment product only. It is not a gambling service. 1. Acceptance of Terms
By accessing, browsing or otherwise using any part of the Service, by creating an account, or by clicking any button or checkbox indicating your agreement, you confirm that you have read, understood and agreed to be bound by these Terms in full, together with our Privacy Policy available at /privacy and our Cookie Policy available at /cookies, both of which are incorporated into these Terms by reference. If you do not agree with any part of these Terms, you must not use the Service, and your only remedy is to stop using it and, if you have an account, to close it.
These Terms form a legally binding agreement between you and Gipfelstürmer Werbeagentur GmbH. They apply to every visit you make to the Service, whether or not you register an account, and they replace any earlier version of the Terms that may have applied to you previously. If any separate rules are published for a specific game, feature or promotion, those rules apply in addition to these Terms; where a specific rule conflicts with these Terms, the specific rule prevails for that game, feature or promotion only.
1.1 Changes to these Terms
We may amend these Terms from time to time, for example to reflect changes in the law, changes to our games and features, improvements to our safety measures, or corrections and clarifications. When we make material changes, we will take reasonable steps to notify you, such as displaying a prominent notice on the Service or sending a message to the email address registered to your account, and we will update the effective date shown at the top of this page. Changes will not apply retroactively. If you continue to use the Service after an updated version of the Terms takes effect, you will be treated as having accepted the updated Terms. If you do not accept them, you must stop using the Service. Nothing in this clause limits any right you may have under mandatory consumer protection law to object to a change that would significantly disadvantage you.
1.2 Capacity to agree
You represent that you have the legal capacity to enter into a binding contract in the place where you live. If you use the Service on behalf of another person or entity, you represent that you are authorised to bind that person or entity to these Terms, although we remind you that accounts are personal and non-transferable as described in Section 3.
2. Eligibility
The Service is strictly intended for adults. You may only access or use the Service if you are at least 18 years of age at the time of access. This is a hard requirement with no exceptions. Even though no real money can be won or lost on Gipfelstürmer Social, our games use mechanics that visually resemble casino-style play, and we consider such content unsuitable for minors under any circumstances.
By using the Service you represent and warrant that:

If we discover that a person under 18 has created an account, we will terminate that account immediately and delete the associated profile data in accordance with our Privacy Policy. If you are a parent or guardian and believe a minor has been using the Service, please contact us straight away using the details in Section 13 so that we can investigate and act.
2.2 Personal responsibility
It is your responsibility to ensure that using a free-to-play social casino platform is lawful for you in your location. While the Service involves no gambling and no money, some jurisdictions regulate simulated gambling content, and we cannot monitor the laws of every territory. If you are unsure, seek local advice before playing. We reserve the right to restrict access to the Service from any jurisdiction at our discretion.
3. Account Registration
You can browse parts of the Service without an account, but to play our games, track your Summit Coins balance and use social features, you will need to register. Registration is free. When you register you agree to provide accurate, current and complete information, including a valid email address, and to keep that information up to date for as long as your account exists. Providing false, misleading or incomplete information is a breach of these Terms and may result in suspension or termination of your account.
3.1 One account per person
You may create and maintain only one account. Creating multiple accounts — whether to accumulate additional Summit Coins, to evade a suspension, to abuse a promotion, or for any other reason — is prohibited. If we detect duplicate accounts, we may close some or all of them, cancel any Summit Coins balances attached to them, and refuse future registration. Accounts are personal to you: you may not sell, rent, lend, gift or otherwise transfer your account or its contents to anyone else, and you may not use an account that belongs to another person.
3.2 Email verification
After registering, you will receive a verification email at the address you provided. You must complete the verification step before your account becomes fully active. If the verification email does not arrive, check your spam folder or contact us at /contact. Accounts that remain unverified for an extended period may be removed. We may also require re-verification at any time if we suspect that the registered email address is no longer valid or under your control.
3.3 Account security
You are responsible for maintaining the confidentiality of your login credentials and for everything that happens under your account, whether or not you authorised it. We strongly recommend that you choose a strong, unique password, that you never reuse a password from another service, and that you never share your credentials with anyone — including people claiming to be Gipfelstürmer Social staff. We will never ask you for your password by email or chat. You agree to:
- keep your password secret and change it immediately if you suspect it has been compromised;
- notify us without delay via /contact if you become aware of any unauthorised access to or use of your account;
- log out of your account at the end of each session when using a shared or public device; and
- refrain from using automated tools, scripts or password managers configured to circumvent our security measures.
We are not liable for any loss arising from unauthorised use of your account that results from your failure to keep your credentials secure, except where such loss is caused by our own negligence or where liability cannot be excluded under applicable law.
4. User Conduct
Gipfelstürmer Social is meant to feel like a friendly alpine lodge, and we intend to keep it that way. When you use the Service, you agree to behave lawfully, honestly and respectfully. The following conduct is strictly prohibited, and engaging in it may lead to warnings, removal of content, adjustment or cancellation of Summit Coins balances, suspension or permanent termination of your account, and, where appropriate, referral to law enforcement.
4.1 Prohibited behaviour
- using the Service for any unlawful purpose or in violation of any applicable law or regulation;
- harassing, threatening, abusing, defaming or intimidating other users or our staff, including through usernames, profile content or chat messages;
- posting or transmitting content that is obscene, hateful, discriminatory, violent, sexually explicit or otherwise objectionable;
- impersonating any person or entity, including our employees or other players, or misrepresenting your affiliation with anyone;
- attempting to collect, harvest or solicit personal information from other users;
- advertising, promoting or linking to real-money gambling services, or soliciting any commercial activity through the Service;
- uploading or transmitting viruses, malware or any other code designed to interrupt, damage or limit the functionality of the Service or any connected system.
4.2 No cheating, exploits or automation
The integrity of our games matters even though the stakes are purely fictional. You must not:
- use bots, macros, scripts, auto-clickers or any other form of automation to play games or interact with the Service;
- exploit bugs, glitches or unintended behaviour in the Service to gain Summit Coins, features or advantages, or fail to report such bugs when you discover them;
- manipulate, reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of any part of the Service, except to the extent such a restriction is prohibited by applicable law;
- tamper with, or attempt to tamper with, the outcome of any game, the operation of our random number generation, or the Summit Coins accounting system;
- scrape, crawl, spider, index or systematically extract data or content from the Service by any automated means, whether for training machine-learning systems, building databases, or any other purpose, without our prior written consent;
- probe, scan or test the vulnerability of our systems, bypass or attempt to bypass any security or access controls, or interfere with the proper working of the Service, including by overloading, flooding or mail-bombing it.
If we determine, acting reasonably, that you have engaged in cheating or exploitation, we may reverse or void any Summit Coins, achievements, leaderboard positions or other in-game outcomes attributable to that behaviour, in addition to any other remedy available to us under these Terms.
5. Virtual Currency
The games on Gipfelstürmer Social use a virtual credit called Summit Coins. This section explains exactly what Summit Coins are and, just as importantly, what they are not. Please read it carefully, because it defines the entire economic character of the Service — which is to say, there is no economic character at all.
5.1 What Summit Coins are
Summit Coins are fictional entertainment credits. They exist only as numbers inside our software. They are a scoring and pacing mechanism that lets our games feel like games: you receive a balance, you play with it, it goes up and down, and that is the whole story. Summit Coins may be granted to you free of charge when you register, at periodic intervals, through in-game achievements, through promotions, or as part of a membership plan as described in Section 6.
5.2 What Summit Coins are not
- Summit Coins have no monetary value. They are not money, e-money, a financial product, a security, a cryptocurrency or a stored-value instrument of any kind.
- Summit Coins cannot be redeemed. There is no mechanism, now or ever, to exchange Summit Coins for cash, goods, services, vouchers, prizes or anything else of value, whether from us or from any third party.
- Summit Coins cannot be purchased with the expectation of return. Nothing you do on the Service converts Summit Coins back into anything outside the Service.
- Summit Coins cannot be transferred. You may not send, trade, sell, gift or assign Summit Coins to any other user or third party, and any attempt to do so — including through external marketplaces — is void and constitutes a breach of these Terms.
- Summit Coins are not property. You receive only a limited, personal, revocable, non-exclusive, non-transferable licence to use Summit Coins within the Service for entertainment purposes, and you acquire no ownership interest in them.
5.3 Balance adjustments
Because Summit Coins are fictional and valueless, we retain complete discretion over them. We may grant, modify, reduce, reset or cancel any Summit Coins balance at any time, including to correct errors, to reverse the results of bugs or exploits, to rebalance our games, or upon suspension or termination of your account. A large Summit Coins balance is a mark of enthusiasm, not an asset: if your balance is adjusted or lost for any reason, including account closure or discontinuation of the Service, no compensation of any kind is payable. Winning Summit Coins in our games says nothing about any person's prospects in real-money gambling, and we make no representation to the contrary.
6. Membership Services
Gipfelstürmer Social offers optional membership plans — Bronze, Silver, Gold and VIP — that enhance the entertainment experience. Membership is never required to use the Service: the free experience is a complete experience, and every game can be enjoyed without spending anything. Membership plans exist for players who want a richer cosmetic and convenience experience, and for no other reason.
6.1 What membership includes
Depending on the tier, a membership plan may include a larger periodic allocation of Summit Coins, cosmetic profile customisations, early access to newly released games, priority support responses, exclusive alpine-themed badges and similar perks. The specific contents of each tier are described on the membership page of the Service and may be updated from time to time. Improvements to a tier apply automatically; if we ever materially reduce what a tier includes during your active billing period, you may cancel and, where required by applicable law, receive a proportionate remedy.
6.2 Billing
Membership plans are billed on a recurring subscription basis in plan credits at the rate displayed for your chosen tier at the time you subscribe. The applicable billing amount, billing interval and renewal date are always shown clearly before you confirm a subscription and remain visible in your account settings. By subscribing, you authorise us to charge the recurring plan amount at each renewal until you cancel. If a renewal payment fails, we may retry it, downgrade your account to the free tier, or suspend membership benefits until payment succeeds. We will give you reasonable advance notice of any change to the price of your plan, and any such change will only take effect from your next renewal, so you always have the opportunity to cancel first.
6.3 Cancellation
You may cancel your membership at any time through your account settings or by contacting us via /contact. Cancellation takes effect at the end of your current billing period: you keep your membership benefits until that date, and you will not be charged again afterwards. We do not impose cancellation fees, minimum terms or exit hurdles. Downgrading between tiers works the same way — the change applies from the next billing period.
6.4 Refunds
Except where a refund is required by applicable law — including any non-excludable consumer guarantees under the Australian Consumer Law or mandatory consumer rights in your place of residence — all membership payments are final and non-refundable, including for partially used billing periods, unused Summit Coins allocations, or dissatisfaction with perks that were accurately described. Nothing in this clause excludes, restricts or modifies any statutory right or guarantee that cannot lawfully be excluded. If you believe you are entitled to a statutory remedy, contact us using the details in Section 13 and we will assess your request in good faith.
6.5 Plans never confer winnings
For the avoidance of all doubt: purchasing a membership plan does not improve your odds in any game, does not entitle you to any prize, payout or winnings of any kind, and does not convert the Service into a gambling product. The Summit Coins included in a plan are subject to Section 5 in full — they are fictional, valueless, non-redeemable and non-transferable. A membership is a payment for entertainment enhancements, exactly as a cinema ticket is a payment for a film, and nothing more.
7. Intellectual Property
The Service and everything in it — including all games, game mechanics, software, source code, graphics, artwork, animations, logos, trade marks, the "Gipfelstürmer Social" name, the Summit Coins name and design, text, audio, video, user interface design, and the selection and arrangement of all of the foregoing — are owned by or licensed to Gipfelstürmer Werbeagentur GmbH and are protected by copyright, trade mark and other intellectual property laws of Germany, Australia and other countries. All rights not expressly granted to you in these Terms are reserved.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own private, non-commercial entertainment. You may not, without our prior written consent:
- copy, reproduce, distribute, publicly display, publish or create derivative works from any part of the Service or its content;
- use any of our trade marks, logos or branding, or anything confusingly similar, in connection with any product or service;
- remove, obscure or alter any copyright, trade mark or other proprietary notice appearing in the Service;
- frame, mirror or embed any part of the Service within another website or application; or
- use any content from the Service for commercial purposes of any kind.
If you submit feedback, suggestions or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or compensation, and you confirm that doing so does not violate any third party's rights. If you believe any content on the Service infringes your intellectual property rights, please notify us using the contact details in Section 13, including enough detail for us to identify the material and assess your claim, and we will respond promptly.
8. Privacy
Your privacy matters to us. Our collection, use, storage and disclosure of your personal information is governed by our Privacy Policy, which you can read at /privacy and which forms part of these Terms. The Privacy Policy explains what data we collect when you register and play, why we collect it, how long we keep it, who we share it with, how we protect it, and the rights you have over it — including rights arising under the EU General Data Protection Regulation, which applies to us as a German company, and the protections of the Australian Privacy Act 1988 to the extent applicable to our Australian audience.
In short: we collect only what we need to operate the Service, we do not sell your personal information, and we use cookies and similar technologies as described in our Cookie Policy at /cookies. By using the Service you acknowledge that you have had the opportunity to read the Privacy Policy. If you have questions or wish to exercise any privacy right — such as access, correction or deletion of your data — contact us using the details in Section 13 or follow the instructions in the Privacy Policy itself.
9. Disclaimer
This section repeats, in one place, the facts that appear throughout these Terms, because they cannot be said too often.
9.1 Entertainment only — no gambling
Gipfelstürmer Social is a free-to-play entertainment platform. It is not a casino, not a betting service, not a lottery and not a gambling product of any description. There is no wagering on the Service: you never stake money or anything of value, and you can never lose money or anything of value by playing. There are no deposits into game play, no withdrawals, no cash prizes, no merchandise prizes and no prizes of any monetary value whatsoever. Every outcome in every game affects only your fictional Summit Coins balance, which Section 5 makes clear is worthless outside the Service. Success at Gipfelstürmer Social carries no implication of success at real-money gambling, and our games do not reflect the odds, payout rates or mechanics of any real gambling product. 9.2 Service provided "as is"
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties, conditions or guarantees of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free or free of viruses or other harmful components, that defects will be corrected, or that the Service will be available at any particular time or location. We may modify, replace, suspend or discontinue any game, feature or the entire Service at any time. Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other mandatory law that cannot lawfully be excluded; where such laws apply, our liability is limited, to the extent permitted, to the resupply of the relevant services or the payment of the cost of having them resupplied.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Gipfelstürmer Werbeagentur GmbH, together with its directors, officers, employees, agents and licensors, will not be liable to you for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with your use of, or inability to use, the Service, however caused and under any theory of liability, even if we have been advised of the possibility of such damages. In particular, and without limiting the foregoing, we accept no liability for the loss, reduction or cancellation of any Summit Coins balance, which — as these Terms repeatedly state — has no value capable of being lost.
To the extent our liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service, whether in contract, tort (including negligence), statute or otherwise, is limited to the total amount you paid to us for membership services in the twelve months immediately preceding the event giving rise to the claim, or, if you have paid nothing, to the resupply of the Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or intent under German law, or for any other liability that cannot be excluded or limited under the mandatory laws of Germany or of your country of residence, including the Australian Consumer Law. Statutory rights that these laws grant you remain fully intact, and this section applies only to the extent the law allows.
You agree to indemnify and hold us harmless from any claims, losses, damages and reasonable costs (including legal fees) asserted by third parties arising out of your breach of these Terms or your unlawful use of the Service, except to the extent the claim results from our own fault. This indemnity does not apply where and to the extent it would be unenforceable under the mandatory consumer law of your place of residence.
11. Suspension
We want every climber on the mountain to play fair, and we reserve proportionate tools to deal with those who do not. We may suspend, restrict or terminate your access to the Service, or any part of it, with immediate effect and without prior notice if, acting reasonably, we believe that:
- you have breached these Terms, including the eligibility requirements in Section 2 or the conduct rules in Section 4;
- you have provided false or misleading information, or failed a verification request;
- you have engaged in cheating, exploitation, automation or scraping as described in Section 4.2;
- your account is being used fraudulently or by someone other than you;
- suspension is necessary to protect the Service, other users or ourselves from harm, or to comply with a legal obligation.
For minor or first-time breaches we will normally issue a warning and give you an opportunity to remedy the situation before taking stronger action, unless the breach is serious or urgent action is needed. Where we suspend or terminate your account, we will tell you the general reason unless the law prevents us from doing so or doing so would compromise an investigation. If you believe we have acted in error, you may contest the decision by contacting us via /contact within thirty days, and we will review it in good faith.
11.1 Termination and its effects
You may terminate this agreement at any time by closing your account through your account settings or by asking us to close it via /contact. We may terminate this agreement for the reasons listed above, or for convenience on reasonable notice if we discontinue the Service. Upon termination for any reason: your licence to use the Service ends immediately; your Summit Coins balance is cancelled without compensation, consistent with Section 5; any active membership ends in accordance with Section 6, with cancellation and refund treatment as described there; and any provisions of these Terms that by their nature should survive — including Sections 5, 7, 9, 10, 12 and 13 — will survive. Termination does not affect rights or obligations that accrued before the termination date.
12. Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims), are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
To the extent permitted by applicable law, the courts of Stuttgart, Germany shall have jurisdiction over any dispute arising from these Terms or the Service. However — and this qualification is important — nothing in this section deprives you of the protection of any mandatory consumer protection laws of the country or state in which you habitually reside, including, for players in Australia, the Australian Consumer Law, nor of any right you may have under those laws to bring proceedings in the courts of your own place of residence. Where the mandatory law of your residence conflicts with German law on a point that cannot be contracted out of, the mandatory law of your residence prevails on that point.
Before commencing any formal proceedings, we encourage you to contact us first using the details in Section 13; most disagreements can be resolved quickly and amicably through our support team. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr, though we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and us regarding the Service.
